Lease or Option?
Windmill lease are long-term contracts that
could affect your use of the property for
many years. You should be aware of the terms
in light of your personal goals for your
property.
1. Who are the parties to the lease? Is the
energy company that will operate the windmill
the party or a middleman?
2. What rights are you retaining concerning-
farming, commercial uses, hunting, etc.
3. Does the lease have a confidentiality
clause? You may want to work with your area
landowners and not have a restriction.
4. Windmill leases may have several phases
which make them more like an option.
a. an evaluation phase, b a production phase,
and c) an extension of the production phase.
5. How are you compensated during the phases?
Based on what standard.
6. May the energy company assign your lease
to another party? Are they released?
7. Property tax considerations based on the
improvements- who pays?
8. What liabilities will you have for the
new use of your property? Will you have insurance?
9. What other restrictions will you have
on your property?
10. Where will the roads, power lines, buildings,
etc. be constructed? What access will the
lessee need to maintain them? Can they construct
new ones?
In summary, these points are just a few of
the concerns you may want to address in a
windmill lease. Since each piece of property
is unique you may want to go slow and evaluate
the long-term implications of the lease.
